In order to obtain the right-of-way for a street improvement project, the City of Lewiston filed an eminent domain action to acquire real property owned by Margaret E. Lindsey. Lindsey counterclaimed alleging causes of action for negligence, inverse condemnation and breach of promise. With respect to the Citys condemnation action, the parties later agreed that Lindsey be compensated $18,000 for the condemned property, and the trial proceeded solely on the issues raised in Lindseys counterclaim. After the parties had presented their cases, but before the matter was submitted to the jury, the district court granted the Citys motion for a directed verdict. Lindsey timely appealed, challenging the order directing a verdict in favor of the City.
